Terms of Use

The agreement between you and MoiMatch

Welcome to MoiMatch.

These Terms of Use (the “Terms”) govern your access to and use of the MoiMatch service on every client we publish: the website, the Android and iOS applications and the Telegram bot (together, the “Service”). The Service is provided by LoadStar Games, the operator of the MoiMatch project (the “Service Provider”, “we”, “us”, “our”). “You” and “User” mean the person who uses the Service.

Please read these Terms carefully before you start. By creating an account, signing in or otherwise using the Service, you confirm that you have read, understood and accepted these Terms in full, together with the Privacy Policy, the Platform Policy, the Cookie Policy and the Child Safety Policy, which form an integral part of this agreement.

If you do not agree with any part of these Terms, you must stop using the Service immediately and delete your account.

1. The MoiMatch Service

MoiMatch is an online dating service that helps adults discover other adults nearby and start a conversation with them. The Service is a neutral technical platform: it transmits, stores and displays material that Users create, and it does not author, endorse or verify that material.

The Service currently includes, among other things:

  • a profile with a name, age, gender, photographs, a free-text description, interests and optional personal facts;
  • a map-based search that shows other Users near a location you choose;
  • a deck of profile cards with a like / pass decision;
  • mutual likes (“matches”) and a list of people who liked you;
  • a chat with text, photo and voice messages between people who may write to each other;
  • push, in-app and e-mail notifications about activity on your account;
  • reporting, hiding and blocking tools.

The Service is provided free of charge in this version. We may add, change, limit, suspend or discontinue any feature, and we may set or change technical limits (for example the number of likes, uploads or messages per day) at any time, with or without notice. Individual features may differ between the website, the mobile applications and the Telegram bot.

2. Eligibility and age requirement

To use the Service you must:

  • be at least 18 years old, and older if the age of majority in your country is higher;
  • have the legal capacity to enter into a binding agreement;
  • never have been permanently blocked from the Service by us;
  • not be prohibited from using a service of this kind under any law that applies to you, and not be listed on any register of sex offenders;
  • use the Service only for your own personal, non-commercial purposes.

Adults only. MoiMatch is strictly 18+. Creating an account means you declare that you are an adult and that the date of birth you enter is your own and is true. Accounts that appear to belong to a minor are blocked without warning, and we cooperate with the competent authorities as described in the Child Safety Policy.

3. Your account

Most features require an account. When you register and while you use the Service you agree to:

  • provide accurate, current and complete information about yourself, including a truthful date of birth and gender;
  • use photographs that genuinely show you and that you are entitled to publish;
  • keep your credentials confidential and not share them with anyone;
  • notify us without delay at info@moimatch.org if you suspect unauthorised access to your account.

You are responsible for everything that happens through your account, including actions taken by anyone you allowed to use it or anyone who obtained access because you failed to keep your credentials safe. We are not liable for any loss arising from unauthorised use of your account.

You may not create more than one account for yourself, create an account to evade a restriction or a block, create an account on behalf of another person without their authority, or sell, buy, rent, share or transfer an account.

4. Your content and the licence you grant

“Your Content” means everything you upload, publish, send or otherwise make available through the Service: photographs, your name and description, interests and facts, text, voice and photo messages, reports and any other material.

Your warranties

Each time you publish or send anything, you represent and warrant that:

  • you are the author or the rights holder, or you hold all rights and permissions needed to publish and send it;
  • every identifiable person shown or described has given their consent to the publication, and every such person is an adult;
  • it does not infringe any third-party right, including copyright, neighbouring rights, trademarks, image, privacy, honour, dignity or business reputation;
  • it complies with these Terms, the Platform Policy, the Child Safety Policy and all laws that apply to you;
  • it is not misleading and does not impersonate any person or organisation.

Ownership and licence

You keep all rights you have in Your Content. We claim no ownership of it.

By publishing or sending Your Content, you grant the Service Provider a non-exclusive, worldwide, royalty-free, sublicensable and transferable licence to host, store, back up, reproduce, adapt in a technical sense (resize, re-encode, strip metadata, create thumbnails and previews), transmit and display Your Content, solely in order to operate, secure, moderate, support and improve the Service — including showing your profile to other Users and delivering your messages to their recipients.

The licence ends when Your Content is removed from public view or your account is deleted, except that (a) copies already received or stored by other Users or by third parties in the ordinary operation of the Service remain unaffected, and (b) we may keep copies as described in section 12 and in the Privacy Policy for safety, moderation, audit, backup and legal purposes.

We do not sell Your Content, do not use it in advertising and do not use it to train machine-learning models.

Feedback

Any idea, suggestion or feedback you send us may be used by us freely, without restriction, attribution, compensation or any obligation of confidentiality.

5. Prohibited conduct

When using the Service, you must not:

  • publish or send any material involving a minor in a sexual or exploitative context, or attempt to contact a minor for such purposes — this is an absolute prohibition with no exception (see the Child Safety Policy);
  • publish sexually explicit or pornographic material, or send it to a person who has not asked for it;
  • harass, threaten, stalk, insult, humiliate, intimidate or bully anyone, or incite others to do so;
  • publish material that incites violence, terrorism, extremism, hatred or discrimination against any person or group;
  • impersonate another person or organisation, including our staff, or misrepresent your age, gender or identity;
  • use the Service for fraud, romance scams, phishing, investment or cryptocurrency schemes, blackmail, extortion, begging or any other deception;
  • use the Service for prostitution, human trafficking, the sale of drugs, weapons or other illegal goods and services;
  • publish or transmit personal data of another person, private correspondence, photographs or recordings without that person’s consent (“doxxing”);
  • send spam, chain letters, advertising or promotional material, or recruit Users to other platforms or services;
  • collect, scrape, copy or store data about other Users, whether manually or automatically, or build a database from the Service;
  • access the Service by automated means (bots, crawlers, scripts, emulators, modified clients) without our prior written permission;
  • interfere with the operation of the Service, its servers or its network, including denial-of-service attacks, malicious code, exploiting vulnerabilities, or circumventing security, rate limits or moderation;
  • reverse-engineer, decompile or disassemble any part of the Service, except to the extent this cannot be prohibited under the law that applies to you;
  • use the Service for any commercial purpose, including promotion, market research, recruitment or the sale of goods and services;
  • do anything unlawful under the law of your country or the country from which you access the Service.

We may extend this list at any time by updating these Terms or the Platform Policy.

6. Moderation, reports and enforcement

We do not review material before it is published. We moderate the Service after publication, by these means:

  • User reports — every profile, card and dialogue has a “Report” control; reports can also be sent to info@moimatch.org;
  • automated checks — technical filters, rate limits and anti-abuse signals;
  • manual review — reports and automated signals are examined by authorised staff.

Reports are reviewed within a reasonable time. If a violation is confirmed, we may remove or hide the material, limit the account (for example prevent it from sending messages or from taking part in the search) or block it permanently. Serious violations lead to an immediate permanent block without prior warning. Our decision on moderation is final; we are not obliged to disclose the details of a report, of our investigation or of the reporting User’s identity.

You may also protect yourself without contacting us: hide a profile, delete a dialogue (which also blocks the other person) or block a person entirely.

Moderation is a right, not an obligation. We do not undertake to monitor all material published through the Service, and the fact that material remains available does not mean we have reviewed or approved it.

7. Your responsibility for content and communication

This section is essential to the agreement between us.

The Service transmits and displays material created by Users. We are not the author of that material and do not control it. Accordingly, you alone are responsible for everything you publish, send, receive and do through the Service, and for the consequences of it, including:

  • the content, accuracy, legality and consequences of every photograph, description, text, voice and photo message you publish or send;
  • the way you communicate with other Users, including the tone, the intentions and the effect of your words;
  • obtaining every consent, permission and licence needed for the material you publish, and for showing other people in it;
  • compliance with all laws that apply to you, including those on personal data, image rights, adult content, defamation and correspondence;
  • any information you choose to disclose to another User, including your identity, contact details, workplace, home area, financial information and photographs — once sent, it cannot be recalled, and the recipient may copy, store or republish it;
  • your decision to trust, meet, transact with, lend money to or enter into any relationship with another User;
  • the security of your device, your account and your credentials.

Each User is likewise solely responsible for their own content and conduct. Content published by other Users is their responsibility, not ours: we do not endorse it, we do not guarantee that it is true, lawful or inoffensive, and we accept no liability for it.

Where the law that applies to you treats you as the controller of personal data you publish about other people, you act in that capacity on your own behalf and not on ours.

In short: what you post and what you say to other people is yours. If it causes harm to anyone — including the person you sent it to, a person shown in it, or a third party — the responsibility, and any claim, cost or penalty resulting from it, is yours and not ours, to the fullest extent permitted by the law that applies.

8. Other users, meetings and personal safety

We do not verify Users. We do not conduct criminal background checks, identity verification, or any other screening of the people who use the Service, and we do not confirm that a profile is genuine, that the photographs show the account holder, or that anything a User says about themselves is true. Profiles created and operated by the Service Provider for demonstration purposes may also exist.

You interact with other Users at your own risk. You are solely responsible for your interactions with them, online and offline, including any meeting, exchange, transaction or relationship, and for taking reasonable precautions:

  • never send money, gift cards, cryptocurrency or financial details to anyone you met through the Service, whatever the reason given;
  • be careful with your identity documents, home address, workplace and intimate photographs;
  • meet for the first time in a public place, tell someone you trust where you are going, and arrange your own transport;
  • stop the conversation and report the person if you feel pressured, threatened or deceived;
  • contact your local emergency services if you believe anyone is in danger — do not wait for our reply.

To the fullest extent permitted by applicable law, the Service Provider is not responsible for the conduct of any User, whether online or offline, and disclaims all liability for any harm, loss, injury, damage or distress arising from your contact, communication, meeting or relationship with another User.

9. Warranties, liability and indemnity

The Service is provided “as is”

The Service is provided on an “as is” and “as available” basis, without warranty of any kind. To the fullest extent permitted by applicable law, we disclaim all express, implied and statutory warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment and non-infringement.

In particular, we do not warrant that the Service will be uninterrupted, timely, secure or error-free; that defects will be corrected; that messages, photographs or other data will always be delivered, stored or preserved; that any profile is genuine; that you will find a match, a partner or any relationship; or that the Service is appropriate or available for use in your location.

Limitation of liability

To the fullest extent permitted by applicable law, the Service Provider, its owners, staff and contractors shall not be liable for:

  • any indirect, incidental, special, consequential, punitive or exemplary damages, or any loss of profit, revenue, data, goodwill or opportunity;
  • the conduct, content, statements or omissions of any User or third party, online or offline;
  • any harm, loss, injury or distress arising from a meeting or a relationship that began through the Service;
  • loss, corruption, disclosure or unavailability of content, messages, photographs or account data;
  • interruptions, faults, maintenance, technical failures or temporary or permanent unavailability of the Service;
  • unauthorised access to your account or device that did not result from our intentional misconduct;
  • third-party websites, applications, application stores, map providers, push and messaging services, e-mail providers and network operators;
  • any consequence of a moderation decision, restriction, block or removal of content made in good faith.

The Service is provided free of charge. Our aggregate liability for all claims arising out of or relating to the Service or these Terms shall not exceed the total amount you actually paid us in the twelve months preceding the event giving rise to the claim — which, in the absence of any payment, is zero.

Indemnity

You agree to indemnify, defend and hold harmless the Service Provider, its owners, staff and contractors from and against any claim, demand, proceeding, liability, penalty, damage, loss, cost and expense (including reasonable legal fees) brought by any third party and arising out of or related to: content you published or sent; your use of the Service; your breach of these Terms or of any other document that forms part of this agreement; your violation of any law or of the rights of any person; or your interaction with any other User.

Mandatory law

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the law that applies to you — for example liability for intentional misconduct, gross negligence, death or personal injury caused by our fault, or rights granted to you by mandatory consumer protection law. Where a limitation in this section is not permitted by that law, it applies only to the extent permitted, and the remaining provisions stay in force.

10. Intellectual property

All rights in the Service — including its software, source code, design, interface, graphics, icons, texts, databases, the name “MoiMatch” and our logos — belong to the Service Provider or its licensors and are protected by intellectual property law and international treaties.

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service in the form in which it is made available, for your own private, non-commercial purposes, in accordance with these Terms. No other right is granted.

You may not copy, modify, distribute, sell, resell, publicly display, create derivative works from, or otherwise exploit any part of the Service, its content or the contact details obtained through it, without our prior written permission.

If you believe that content available through the Service infringes your rights, write to info@moimatch.org following the procedure set out in the Platform Policy.

11. Privacy and data protection

To operate the Service we collect and process certain information about you. What we collect, why, with whom we share it, how long we keep it and what choices you have are described in the Privacy Policy, which forms part of these Terms. Information about cookies and similar technologies is in the Cookie Policy; the notice published for the mobile applications is the mobile Privacy Policy.

By using the Service you acknowledge that your profile, including your photographs, name, age, gender, description, interests and approximate distance from other Users, is shown to other Users of the Service. Do not publish anything you are not prepared to make visible to strangers.

Where the law that applies to you requires your consent for a particular processing operation — for example for the use of your location or for sending notifications — that processing takes place only after you give that consent through your device or account settings, and you may withdraw it at any time in the same place.

12. Advertising

The Service is free of charge and is funded in part by advertising. Ad blocks appear on the map, in the card deck and in the Telegram bot. Every block is marked as advertising, and there is no setting that removes them.

Advertising is served by us, from our own storage. We do not use advertising networks or advertising SDKs, and we do not share your personal data with advertisers — see section 13 of the Privacy Policy.

An ad leads to a website that we do not operate. We check advertisements before they run, but we do not control what happens on the destination site, and we are not responsible for the goods, services, offers or content you find there, nor for any dealings between you and the advertiser. Follow an advertised link at your own discretion, and read that site’s own terms before you give it anything.

If an ad is misleading, unlawful or otherwise inappropriate, report it to info@moimatch.org and we will review it.

13. Suspension, termination and deletion

You may stop using the Service at any time and delete your account from the application menu or at moimatch.org/delete-account.

We may restrict, suspend or terminate your access to the Service, in whole or in part, with or without notice, if:

  • you breach these Terms, the Platform Policy or the Child Safety Policy;
  • your conduct creates a risk for other Users, for third parties or for the Service;
  • we receive substantiated reports about you;
  • we are required to do so by a competent authority or by applicable law;
  • we reasonably consider the measure necessary to protect the Service or the people who use it.

When an account is deleted, the profile stops being shown to other Users and sign-in is disabled. Because we operate a moderated service that must be able to investigate abuse and answer lawful requests, content and account records are not erased from our systems and backups by that action: they are retained and remain accessible to authorised administrators. Retention is described in the Privacy Policy; where the law that applies to you grants you a right to erasure, write to info@moimatch.org and we will assess your request under that law.

Sections that by their nature should survive termination — in particular sections 4, 7, 9, 10 and 14 — remain in force after your account is deleted.

14. Changes to these Terms

We may amend these Terms at any time. The current version is always published at moimatch.org/docs/terms with the date of the last update in its header.

We will notify Users of material changes through the Service or by another reasonable means at least 7 days before they take effect, unless a change must apply immediately for legal or security reasons. Continued use of the Service after a change takes effect means you accept the amended Terms. If you do not accept them, stop using the Service and delete your account.

15. Governing law and disputes

These Terms and any dispute arising out of them or out of your use of the Service are governed by the law of the country in which the Service Provider is established, without regard to its conflict-of-law rules, and the courts of that country have jurisdiction.

This does not deprive you of the protection of the mandatory rules of the law of your country of residence: where such rules give you additional rights, or the right to bring proceedings before the courts of your own country, those rules prevail to the extent that they are mandatory.

The place of establishment of the Service Provider is disclosed on request: write to info@moimatch.org and we will tell you which law and which courts this section refers to.

Before starting proceedings, please write to us at info@moimatch.org: most disputes can be settled by correspondence, and we undertake to consider every complaint in good faith and within a reasonable time.

16. General provisions

  • Entire agreement. These Terms, together with the Privacy Policy, the Platform Policy, the Cookie Policy and the Child Safety Policy, constitute the entire agreement between you and the Service Provider regarding the Service.
  • Severability. If a provision is held invalid or unenforceable, it is replaced by a valid provision that comes closest to its purpose, and the remaining provisions stay in full force.
  • No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
  • Assignment. You may not assign or transfer your rights under these Terms. We may assign them to a successor of the MoiMatch project, provided your rights are not diminished.
  • Notices. We may contact you through the Service, by push notification or at the e-mail address linked to your account. You can reach us at the address in section 16.
  • Language. These Terms are published in English. Any translation is provided for convenience only; in case of discrepancy, the English text prevails.
  • Force majeure. Neither party is liable for a failure caused by an event beyond its reasonable control, including network or hosting failures, acts of authorities, or restrictions on access to the Service in a particular territory.
